Separation Agreement

If you have agreed financial matters with your spouse, we can formalise it with a legally binding separation agreement. A formal agreement isn’t always needed but in certain cases it is essential such as:

  • Large debts
  • Jointly owned property
  • Pensions to be shared

We do not take part in negotiations on your behalf but if you are still negotiating with your spouse, we can offer guidance on the type of settlement you should be aiming for in line with the current law.

What to expect

On receipt of your order we will email you a questionnaire that gives us the background information on your marriage and separation.

Once we have this we will contact you to discuss the terms of the agreement.

Timescales vary depending on the complexity of the agreement but in the majority of cases we have it completed in a week.

The signed agreement is then sent to Registers of Scotland, they keep the original in their vault and send you and your spouse officially registered stamped, bound copies.

The costs involved

Our fee for a standard agreement is fixed at £249. A further fee of £200 is payable if there is a pension sharing order due to the additional work involved.

By selecting PayPal at checkout our fee can be paid in 3 interest free monthly instalments.

When registering the agreement a £22 fee is payable directly to Registers of Scotland.
